Our store is hosted on Shopify, which provides the online platform we use to sell our products to you. Please read this policy alongside our Terms of Service.

1. The information we collect

Depending on how you interact with us, we may collect and process the following personal data:

Identity and contact details — your name, email address, phone number, billing address and delivery address.
Order and payment information — details of the products you buy, your order history and payment information. Card payments are processed securely by our payment providers; we don't see or store your full card number.
Account information — if you create an account, your login details, saved addresses and preferences.
Communications — the content of emails, messages, reviews or other communications you send us, including customer service enquiries and return requests.
Marketing preferences — whether you've opted in to receive marketing from us and how you interact with our emails.
Technical and usage data — your IP address, browser type and version, device type, operating system, time zone, referring website, the pages and products you view or add to your basket, and how you navigate our website. This is collected automatically through cookies and similar technologies (see section 6).

We collect this information directly from you (for example, when you place an order, create an account, sign up to our emails or contact us), automatically through your use of our website, and from third parties such as Shopify, payment providers and delivery carriers.

2. How we use your information and our lawful basis

Under UK data protection law we must have a lawful basis for processing your personal data. We use your information for the following purposes:

To process and deliver your orders, including taking payment, arranging delivery, sending order confirmations and shipping updates, and handling returns, exchanges and refunds. Lawful basis: performance of a contract with you.
To manage your account and provide you with customer service and support. Lawful basis: performance of a contract; our legitimate interests in running our business effectively.
To send you marketing communications about our products, offers, launches and news, where you've opted in or where we're otherwise permitted to do so. You can unsubscribe at any time. Lawful basis: your consent; or, for existing customers, our legitimate interest in promoting similar products, subject to your right to opt out.
To show you relevant advertising on social media and other websites, and to measure the effectiveness of our marketing. Lawful basis: your consent (where given through our cookie settings) and our legitimate interests.
To improve our website and products, including analysing how customers use our site, understanding what's popular, and testing new features. Lawful basis: our legitimate interests in improving our business.
To keep our website and customers safe, including preventing and detecting fraud, unauthorised transactions and misuse of our website. Lawful basis: our legitimate interests; compliance with legal obligations.
To comply with our legal obligations, such as tax and accounting rules, consumer protection law, and responding to lawful requests from authorities. Lawful basis: compliance with a legal obligation.

Where we rely on legitimate interests, we've considered and balanced those interests against your rights and freedoms, and we won't process your data where your interests override ours.

3. Marketing

We'll only send you marketing communications if you've opted in, or if you're an existing customer and we're telling you about products similar to those you've bought (in which case you'll always be given the chance to opt out). You can unsubscribe at any time by clicking the unsubscribe link at the bottom of any marketing email or by emailing support@martzey.com. We'll still send you essential messages about your orders and account even if you opt out of marketing.

4. Who we share your information with

We don't sell your personal data. We share it only where necessary with:

Shopify, which hosts our store and processes data on our behalf to power our website, checkout and order management. You can read Shopify's privacy policy at shopify.com/legal/privacy.
Payment providers you choose at checkout, to process your payment securely and help prevent fraud.
Delivery carriers and fulfilment partners, so they can deliver your order and provide tracking.
Marketing, email and analytics providers that help us send communications, run advertising and understand how our website is used.
Professional advisers such as accountants, lawyers and insurers, where necessary.
Regulators, law enforcement and other authorities, where we're required to do so by law or to protect our rights, our customers or others.
A buyer or successor, if we sell, transfer or merge parts of our business or assets, in which case the new owner may use your data in the same way set out in this policy.

All third parties who process data on our behalf are required to keep it secure and to use it only for the purposes we specify.

5. International transfers

Some of our service providers, including Shopify, are based or operate outside the United Kingdom, which means your personal data may be transferred to and stored in other countries. Where this happens, we make sure appropriate safeguards are in place, such as transferring data only to countries that the UK government has deemed to provide an adequate level of protection, or using the UK International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses.

6. Cookies

Our website uses cookies and similar technologies (such as pixels and local storage) to make the site work, remember your basket and preferences, understand how visitors use the site, and deliver relevant advertising. These fall into the following categories:

Strictly necessary cookies — required for the website and checkout to function, for example keeping items in your basket. These can't be switched off.
Analytics and performance cookies — help us understand how visitors use our site so we can improve it.
Marketing and advertising cookies — used by us and our advertising partners to show you relevant ads and measure campaign performance.

Where required by law, we'll ask for your consent before setting non-essential cookies, and you can change your preferences at any time through our cookie settings or your browser settings. 7. How long we keep your information

We keep your personal data only for as long as we need it for the purposes described in this policy, including to satisfy legal, accounting or reporting requirements. As a general guide, we keep order and transaction records for six years after the end of the relevant tax year, as required by UK tax law; account information for as long as your account is active; and marketing preferences until you unsubscribe or ask us to delete your data. When your data is no longer needed, we securely delete or anonymise it.

8. How we keep your information safe

We use appropriate technical and organisational measures to protect your personal data, including encrypted (SSL) connections across our website, secure PCI-compliant payment processing, and access controls that limit who can see your data. However, no method of transmission over the internet is completely secure, and we can't guarantee absolute security. We recommend that you keep your account password confidential and avoid sending sensitive information by unsecured email.

9. Your rights

Under UK data protection law you have the following rights over your personal data:

Access — to ask for a copy of the personal data we hold about you.
Rectification — to ask us to correct inaccurate or incomplete data.
Erasure — to ask us to delete your data in certain circumstances.
Restriction — to ask us to limit how we use your data in certain circumstances.
Portability — to receive the data you've provided to us in a structured, machine-readable format and to have it transferred to another organisation.
Objection — to object to processing based on our legitimate interests, and to object at any time to direct marketing.
Withdraw consent — where we rely on your consent, to withdraw it at any time. This won't affect processing that took place before you withdrew it.
Automated decision-making — not to be subject to decisions based solely on automated processing that have a legal or similarly significant effect on you. We don't currently make decisions of this kind.

To exercise any of these rights, email us at support@martzey.com. We may need to verify your identity before responding. We'll respond within one month, though this may be extended by up to two further months for complex requests. There's normally no charge, but we may charge a reasonable fee or refuse a request if it's manifestly unfounded or excessive.

If you're not happy with how we've handled your data or your request, you have the right to complain to the Information Commissioner's Office (ICO), the UK's data protection regulator, at ico.org.uk/make-a-complaint or by calling 0303 123 1113. We'd appreciate the chance to resolve your concerns first, so please contact us before approaching the ICO. If you're based in the EU, you may also complain to your local data protection authority.

10. Children

Our website and products aren't directed at children, and we don't knowingly collect personal data from anyone under 18. If you believe a child has provided us with personal data, please contact us and we'll delete it.

11. Third-party websites

Our website may contain links to other websites and social media platforms. We're not responsible for the privacy practices of these third parties, and we encourage you to read their privacy policies.

12. Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in our practices or in the law. We'll post the updated version on this page and change the 'Last updated' date above. Where changes are significant, we may also notify you by email.
